McDonald's sued over nude photos

A US couple is suing McDonald's for $3m (£2m) after nude photos of the woman, which were on her husband's mobile phone, ended up on the internet.

Phillip Sherman says he accidentally left his phone, with the photos, at a McDonald's in Fayetteville, Arkansas.

He says staff promised to secure the phone until he could retrieve it.

The Shermans claim they had to move to a new home after the woman's name, address, and phone number appeared online along with the photos.

Tina Sherman says she began receiving offensive calls and text messages about the pictures from her husband's mobile phone after he left it at the McDonald's on 5 July.

The couple then discovered that the nude pictures she had sent to her husband's phone had been posted online.

The Shermans are suing McDonald's Corporation, the owner of the franchise involved and the restaurant's manager, saying they have suffered emotional distress, embarrassment and damage to their reputations.

They also allege loss of earnings and want to recover the cost of moving to a new home.

McDonald's Corp, the franchise owner and the manager have so far refused to comment on the case.

The nude pictures have been removed from the website that had posted them.

Even though technically I hate America's sue-mentality, this one kinda makes sense. Sure it's dumb to leave embarrassing pictures on your phone, the result of them appearing on internet is an inherent risk if you leave the phone lingering around.

You're also still an asshole if you put the pictures online. Even more so, the company gave their word that they'd take care of the phone after the couple lost it. So the phone's privacy (lol) was violated (double lol) while the phone was in the care of the company.

So it makes sense. 3 mill is a very reasonable sum to demand from a company like macdo.

eh.. How do they know it was a McDonalds employee who did it? Between the time when they left the restaurant to when they advised of said mobile phone it could have been anyone. Maybe even someone they knew! It sounds stupid to me.

Ha, but according to the story, MacDonalds said they would look after the phone for them, in doing so they become responsible for it.

What about the time before they were contacted by the couple? Also how do they know those photo's weren't put up by anyone else besides McDonald's staff?

How do you find out a suspect is guilty? You charge him and find out.

the one good thing about this is that mcdonald's do have the money anyway. i just hate the whole suing thing. you shouldn't be taking dirty pics in the first place you whore, you shouldn't leave them on your phone, and you shouldn't forget your phone. you did all three of those things; you fucked up. stop blaming the world because you're a whore, own up to yourself. one might say what happened is a natural result of doing what she did, and that's why you try not to do what she did, but it does happen. i say. but then again, at least it's mcdonald's she's suing.

she is an idiot for keeping them on her phone, and forgetting her phone. curiosity is human nature, and she is blaming mcdonald's as a corporation, and the manager of the local mcdonalds, for having employees that are human. i just think, if you make that mistake you don't deserve money from someone else, other than maybe the person who physically stole the pictures.

she's a whore for feeling entitled to money because she made mistakes. it's so typically weak to blame everyone and everything around you for your own predicaments. if you don't want this to happen, don't send nude photos. if you send nude photos, realize that you are empowering the receiver with something that could backfire on you. don't like those odds, save it for the bedroom. if you're fine with that this shouldn't be a big deal. this is just MY opinion though, even though i didn't specify that i am not saying my opinion is correct. just gave my input.

i seen a news story once where a colleague of macdonalds was held and detained in a macdonalds work office accused of stealing, she was then forced to undress as if to prove she wasn't hiding anything stolen on her person, this story was caught on security camera and the perpetrators were charged, there was a video accompanying the story which led to the prosecution

Fred, I understand where you're coming from and in the big picture I agree, but don't you agree that in this situation, the company did break their word/were negligent whatever. They said they'd look after they phone, they obviously didn't.

The case has a point imo. And it's not like 2-3 million from a business like MacDonalds in a suit that actually has a point is a weird claim.

I'm just saying this is a far cry from the idiot that sued his drycleaners for 26 million, or the famous case of the dumb bitch that sued MacDo because she spilled hot (duh) coffee on herself.

I'm suing McDonalds because I ordered a small fries and they gave me a large one. It was very stressful for me to try to eat them all. I lost time at work and missed some TV shows because I was sleeping those extra fries off.

I'm also suing the populace in general for the stupidy I have to put up with on a daily basis.

They did, and I appreciate all that. I still just don't think she deserves money for taking nude pictures on her phone and leaving it by mistake. It's her fault there were nudes on the phone. No matter what anyone promised her, McDonalds could have a sign saying "Takes no responsibility for personal effects" and that wouldn't be weird at all. But yeah, I see the not keeping their word angle. I just don't think that warrants paying money.

My problem with this and any other stupid lawsuit done in America is the implications of winning such a lawsuit. I'm thinking, what goes on in this woman's head? She feels entitled to money for being liberal and "sexually liberated" and getting exposed for it, and she wins. Sooo.... What's this woman's view of the world and the legal system? To me it's never about what company it is, or even what happens, in many cases. Where I come from you can't sue unless you've been publicly harassed or physically abused. It's normal to sue for reperations after being kidnapped or raped, or when someone is in a breach of contract. This is just so fucked up to me.
